Xie Yanyi: Not Filing a Rape Case Is Raping the Law—Addressed to the Person in Charge of Discipline Inspection and Supervision in Zhejiang over the “Hangzhou Drinking-Party Incident”

Mr. Fu Mingxian, the person in charge of discipline inspection and supervision in Zhejiang:

I recently learned through CCTV.com that on August 18, 2026, the Hangzhou Investigation and Disposition Group issued a situation report: Recently, our city’s public security authorities received a report from members of the public alleging that they had suffered unlawful harm. Because the case involved violations of discipline and law by public officials, the municipal Party committee and government attached great importance to it, immediately established an Investigation and Disposition Group, and began investigating and handling the matter. It was found that on the evening of July 26, criminal suspects Zhao Moufeng (male, a senior executive at an enterprise) and Yu Mudong (male, a public official in Hangzhou’s Binjiang District) forcibly molested the victim during activities at a KTV after a meal; during the incident, Zhao Moufeng pushed the victim to the ground, causing an injury to the victim’s waist. The victim is currently receiving treatment in hospital and has preliminarily been assessed by a judicial appraisal institution as having suffered a Level II minor injury. The public security authorities have lawfully placed criminal suspects Zhao Moufeng and Yu Mudong under criminal detention, and the case is under further investigation. Yu Mudong has been removed from office; Zhao Moufeng has also been removed from his position by the company he worked for. The discipline inspection and supervision authorities have received relevant leads concerning the matter and will conduct a serious investigation and handle it in accordance with regulations, discipline and law, showing absolutely no leniency.

It is unacceptable to public opinion, unacceptable under the law, and unacceptable according to justice that the Hangzhou Investigation and Disposition Group and Hangzhou police have instead opened a case and taken action against the suspects in the name of forcible indecent assault!

If this is not evading the more serious issue and shielding dereliction of duty, then what is it? Not opening a case under the charge of rape is raping the law and raping public opinion! What more could one ask for?

Now, in my capacity as a legal professional and as a citizen, I hereby submit the above report and complaint to Your Excellency at your authority pursuant to Article 41 of the Constitution of the People’s Republic of China. I ask Your Excellency to immediately perform your statutory duties and supervise the correction of unlawful acts of dereliction of duty!
