Matters reported

1. Relevant staff of the Weicheng District Public Security Bureau shirked their duties, hastily and in violation of regulations issued a petition response, breached their promise to reinvestigate the case concerning the abnormal death of Wang Xiaogang while detained at the Weicheng District Detention Center, which had been transferred by the Central Inspection Team, and engaged in administrative inaction and misconduct;

2. Relevant public security personnel are suspected of deliberately delaying and falsely investigating the case, and, under the pretext of requesting time-point records for video footage, are suspected of intending to alter or destroy key evidence in the case;

3. Zhang Minghui, director of the detention center involved in the case, and others are suspected of abusing detainees and causing Wang Xiaogang’s abnormal death through dereliction of duty. The relevant case-handling agencies, the Xianyang Public Security Bureau and the Weicheng District Public Security Bureau, have refused to transfer clues concerning official crimes to the discipline inspection commission and have shielded the persons involved in the case。

I、Original account of the case:

See the Criminal Complaint Regarding Zhang Minghui, Director of the Weicheng District Detention Center of Xianyang City, and Others’ Suspected Crimes of Dereliction of Duty and Abuse of Detainees

II、From the time of the incident to the present, the family of victim Wang Xiaogang has traveled everywhere to file complaints and reports over the injustice, but they have sunk without a trace and endured suppression and persecution. With nowhere else to turn, on May 7, 2026, they sent complaint materials and relevant evidence by express mail to Shi Kehui, head of the Central Inspection Team’s 12th team. The tracking number was 1190500659148。

III、The Central Inspection Team supervised the case at multiple levels. The victim’s family mistakenly believed that the wrongful case had reached a turning point toward redress. Account of the meeting with the Weicheng District Public Security Bureau on May 21, 2026:

On the morning of Thursday, May 21, 2026, Chen Xiaoming, director of the petitions division of the Weicheng District Public Security Bureau, asked me to meet him at 9 a.m., saying that a petition forwarded by the Ministry of Public Security had been sent down and that he would give me a response in person. I arrived at the petitions office of the Weicheng District Public Security Bureau as agreed. Deputy Director Wang Haijie, Petitions Division Director Chen Xiaoming and a young police officer who said he was surnamed Guo received me together, recording me throughout with body-worn cameras.

They showed me a written petition response, whose general content was: Regarding my complaint that Zhang Minghui, director of the Weicheng District Detention Center of Xianyang City, and others were suspected of dereliction of duty and abusing detainees, investigation had found no evidence proving that the detention center had committed any criminal acts. After that, these people kept urging me to sign. I did not accept the conclusion in the response and hoped to discuss the details of the case with them calmly. I asked how they had conducted the investigation. At first they said that the Weicheng District Public Security Bureau had a special investigation team, while the petitions division was only responsible for running errands and conveying the investigation results. I asked to make an appointment with staff members of the investigation team to discuss the matter. At first they said that was possible, but then said that staff from their petitions office had gone to the Weicheng District Procuratorate to learn about the investigation, and that the result of the Weicheng District Procuratorate’s investigation was this.

Deputy Director Wang Haijie and the police officer surnamed Guo said to me impatiently that the crimes of dereliction of duty and abusing detainees were not under the jurisdiction of the public security bureau, but fell within the procuratorate’s area of work, and told me to go to the procuratorate.

I asked them which illegal acts by staff at the Weicheng District Detention Center fell under the jurisdiction of the public security bureau, and what work the public security bureau’s police supervision team was responsible for.

They said that the public security bureau could not handle illegal acts by staff at the Weicheng District Detention Center and told me to report them to the discipline inspection commission. They said that Director Zhang Minghui had been taken away by the discipline inspection commission about half a year earlier, but not because of Wang Xiaogang’s matter; he had been taken away for committing other offenses.

This conduct violated Article 29 of the Provisions on Procedures for Public Security Organs Handling Criminal Cases—public security organs have a statutory duty to conduct preliminary investigations into cases involving abuse of detainees; violated Article 6 of the People’s Police Law—public security organs have a statutory duty to maintain security at places of detention and investigate illegal and criminal conduct by police officers; and also violated Article 28 of the Regulations on Petition Work, which stipulates that petition demands must not be shirked or handled perfunctorily.

IV、Officials of the Xianyang Public Security Bureau took the initiative to receive petitioners at the Weicheng District Public Security Bureau, taking photographs and recording video throughout, apparently for show.

While Deputy Director Wang Haijie and the police officer surnamed Guo were passing responsibility back and forth with me, Division Director Chen Xiaoming came in and out several times, then told me that the person in charge of petitions at the Xianyang Public Security Bureau was coming to the Weicheng District Public Security Bureau to meet me and asked me to wait patiently. I said that if I could meet with the Xianyang Public Security Bureau’s petitions official that day, that would be even better; my aim was to resolve the problem as soon as possible.

After I had waited for nearly an hour, Deputy Director Zhang of the Xianyang Public Security Bureau and Wang Yuanhang, director of its petitions office, arrived. Chen Xiaoming showed the written petition response given to me to Deputy Director Zhang and Wang Yuanhang. After reading it, Deputy Director Zhang and the others began urging me to sign. I said that I did not accept the conclusion and requested to discuss the case. Deputy Director Zhang said that he had never dealt with my family’s petitioning matter and did not know its background. I then recounted to Deputy Director Zhang and the others the course of the work-injury case between Wang Xiaogang and his employer, the Third Thermal Power Company, beginning in 2006; the September 2022 incidents in which Ma Yongkui, a person hired by the local government, came to the house with a 30-centimeter-long knife to attack people, and his son Ma Jianjun drove an off-road vehicle to the house, ran over and killed his father Ma Yongkui and injured the more-than-80-year-old Wang Yingqiang; and how the Xixian New Area Public Security Bureau and other case-handling agencies, in order to shield the real killer Ma Jianjun, used a forged assessment to frame and blame mentally ill patient Wang Xiaogang, forcibly detained him at the Weicheng District Detention Center of Xianyang City, where he ultimately died after being abused. Wang Xiaogang was mentally ill and clearly did not meet the conditions for admission under the detention-center regulations, but Zhang Minghui forcibly admitted him and then caused his death. He must be held legally accountable for life.

After the incident, accompanied for a long period by police officers Wang Chao and Wang Huajiang of the Weicheng District Public Security Bureau, I watched surveillance video from Room 206 covering the 10 days before Wang Xiaogang’s death, as well as video of Wang Xiaogang being treated in hospital.

While watching the video, police officer Wang Chao of the Weicheng District Public Security Bureau repeatedly told me that personnel sent by the bureau had already watched the footage once in advance and had only given it to me after confirming that there was no problem. Strangely, although these videos were all 24-hour recordings and should have contained both sound and images, they often had no sound for seven or eight hours, or even more than 10 hours, and the images kept flickering, suggesting that the footage had been manually processed and that scenes had been switched.

Despite this, I still captured many detailed problems in the video and made written records—for example, several detainees in the same room bullied Wang Xiaogang over a long period while the guards turned a blind eye, and Wang Xiaogang lost consciousness repeatedly without receiving treatment. I described these matters to Deputy Director Zhang and the others. Deputy Director Zhang and Director Wang Yuanhang whispered that these images should not have appeared and asked how I could have seen them.

I said that it was impossible for the police of the Weicheng District Public Security Bureau to watch hundreds of hours of video as carefully as the victim’s family. At most, they had processed and deleted the more obvious criminal acts, but had failed to notice and completely delete the details. As a result, I saw them, and the details could also demonstrate their criminal acts.

Deputy Director Zhang asked what demands I had. I said I had only two: first, to hold all persons involved legally accountable, including the detainees who had bullied Wang Xiaogang; second, to provide economic compensation to victim Wang Xiaogang and his family.

Deputy Director Zhang said he would send people to reinvestigate the case and would not let any person involved escape responsibility. Even if the detainees who had bullied Wang Xiaogang had already been released, they could be arrested again.

Deputy Director Zhang then asked whether anyone had previously discussed economic compensation with me. I said that Wang Chao and Wang Huajiang had both raised the subject during the process of watching the video. At the time, they said that three detainees had previously died at the Weicheng District Detention Center, and that each case had been settled by paying 70,000 yuan, implying that Wang Xiaogang would receive no more than 70,000 yuan.

I asked Deputy Director Zhang whether he thought putting a price of 70,000 yuan on a human life was appropriate. Deputy Director Zhang, Director Wang Yuanhang and the others then asked me on the spot how much economic compensation I wanted. Deputy Director Wang Haijie said, “There is no such thing as an excessive opening demand; the price is negotiated down. Name a figure today.” I said I had to go home and discuss it with my father, Wang Yingqiang, and see what the family elder thought.

Chen Xiaoming took away the written response given to me and said that since Deputy Director Zhang had ordered a reinvestigation, they would respond to me again after the new investigation results came out.

After returning home, I immediately reported to my father, Wang Yingqiang, what had happened in my discussions with the officials at the Weicheng District Public Security Bureau and asked how much economic compensation he wanted. My father, Wang Yingqiang, shouted in great agitation: “They have left me without descendants. This is not a matter of how much money to pay. First arrest all the criminals, then calculate the economic compensation in accordance with the State Compensation Law.”

V、On May 25, 2026, the Weicheng District Public Security Bureau suddenly changed its conclusion and has still not issued any written response

At 9:47 a.m. on May 25, 2026, Chen Xiaoming, director of the petitions division of the Weicheng District Public Security Bureau, called and said: After meeting and speaking with me on May 21, the leaders had attached great importance to the matter and conducted a serious investigation; the result was that there was no legal basis for finding that the Weicheng District Detention Center had committed any criminal acts. Chen Xiaoming also asked me to provide him as soon as possible with written records of the time points of illegal acts in the surveillance video, saying that the public security bureau did not have the time to watch such a long video.

I was helpless. May 21 was a Thursday, and only one working day—May 22—had passed. How had the leaders managed, within one working day and without being willing to watch the surveillance video, to attach great importance to the matter, conduct a serious investigation and reach a conclusion? I seriously suspect that Chen Xiaoming’s request for detailed written records of the video time points was preparation for again cutting and processing the video and destroying evidence.

VI、On May 26, 2026, the family of victim Wang Xiaogang spoke by telephone with Wang Yuanhang, director of the petitions office of the Xianyang Public Security Bureau

With no alternative, on May 26, 2026, I called the petitions office of the Xianyang Public Security Bureau at 029-33880126, hoping to speak with Director Wang Yuanhang. With the assistance of petitions staff, I finally reached Director Wang Yuanhang. I reported to Director Wang the circumstances of Division Director Chen Xiaoming’s call to me on May 25 and hoped that he could help me arrange another meeting with Deputy Director Zhang so that the matter could be advanced and resolved as soon as possible. Director Wang Yuanhang said that Shen Zuben, the newly appointed director of the Weicheng District Public Security Bureau, wanted to meet me within the week and hoped that I would not refuse. I said that meeting and speaking with the officials would be a good thing and that I certainly would not refuse. Wang Yuanhang again asked how much economic compensation my father wanted. I conveyed my father’s position: first hold all persons involved accountable, then discuss economic compensation. The State Compensation Law has detailed calculation standards, so compensation could simply be calculated under that law.

As of now, the newly appointed director of the Weicheng District Public Security Bureau, Shen Zuben, has not sent anyone to contact me for a meeting. Deputy Director Zhang of the Xianyang Public Security Bureau has also remained evasive and has given no response. It is difficult to obtain a second meeting.

Legal grounds corresponding to the violations of laws and regulations by the persons involved

I、Relevant provisions concerning administrative duties

1. Article 30 of the Regulations on Petition Work:Relevant organs and units shall handle petition matters in accordance with regulations and the law, and must not handle petition matters perfunctorily, pass responsibility back and forth, or handle petition matters falsely. The public security personnel involved first promised to reinvestigate, then reversed that promise and repeated the original conclusion without conducting any substantive investigation in a short period of time, constituting false handling of a petition.

2. Articles 2 and 4 of the Regulations on Supervision by Public Security Organs:Supervision organs of public security organs shall, in accordance with the law, conduct on-site supervision and investigate clues concerning the performance of duties and violations of law and discipline by detention-center police. Wang Haijie and the others completely evaded the public security authorities’ supervisory responsibilities on the grounds that the matter fell under the jurisdiction of the procuratorate or the discipline inspection commission, violating their statutory duty to perform supervision.

3. The Work Provisions for Public Security Organs Handling Petition Matters:Investigation of petition matters shall involve obtaining original evidence and comprehensively verifying case files and audio-visual materials. The case-handling agency’s groundless refusal to investigate the surveillance footage itself, while instead requiring the petitioner to organize the evidence time points, violated procedure.

II、Relevant provisions concerning criminal accountability(detention-center personnel involved)

1. Article 248 of the Criminal Law of the People’s Republic of China【Crime of Abusing Detainees】:Where custodial personnel at prisons, detention houses, detention centers and other custodial institutions beat or physically abuse detainees, causing death, they shall be convicted and punished more severely for intentional injury or intentional homicide.

2. Article 397 of the Criminal Law of the People’s Republic of China【Crime of Dereliction of Duty】:Where state-agency personnel are seriously irresponsible and fail to perform, or fail to conscientiously perform, their duties, causing major losses to public property or to the interests of the state and the people, they shall be held criminally accountable.

III、State compensation

Articles 17 and 34 of the State Compensation Law of the People’s Republic of China:Where a detention center or its staff cause a person’s death in the exercise of their functions and powers, the victim’s immediate family members have the right to apply for criminal compensation, with the amount calculated in accordance with statutory standards.

Requests in the report

1. The Central Commission for Discipline Inspection and the National Commission of Supervision should assume jurisdiction at a higher level and investigate the disciplinary and unlawful conduct of Wang Haijie, Chen Xiaoming, Deputy Director Zhang, Wang Yuanhang and others in falsifying petition matters, failing to perform administrative duties and shirking responsibility for handling the case, and impose administrative sanctions in accordance with law and regulations;

2. The complete original surveillance recordings of Room 206 involved in the case should be lawfully obtained and sealed, and a third-party judicial appraisal institution should be commissioned to determine whether the video had been edited, deleted or altered, with the responsibility of persons suspected of destroying evidence thoroughly investigated;

3. Clues concerning the suspected crimes of abusing detainees and dereliction of duty by Zhang Minghui and other detention-center guards and relevant case-handling police officers should be transferred to the procuratorate for filing and investigation, and all persons involved in the case—including the detainees who carried out the bullying—should be held criminally accountable in accordance with the law;

The various compensation costs arising from Wang Xiaogang’s abnormal death should be calculated in accordance with the State Compensation Law, and state compensation should be implemented in accordance with the law.

I、Basic facts:

Victim Wang Yingqiang’s son, Wang Xiaogang, was bitten and frightened into developing mental illness in 2007 when he was working for China Energy Construction Group Northwest Electric Power Construction No. 3 Company after someone deliberately released a guard dog at the workplace. Wang Yingqiang petitioned for 16 years without receiving lawful handling. Instead, the Weicheng Subdistrict Office and a state-owned enterprise hired Ma Yongkui to unlawfully monitor and persecute Wang Yingqiang’s family for years and stop and intercept their petitioning by any means. Every time Wang Yingqiang or a family member went elsewhere to petition, Ma Yongkui would telephone the leaders to report on them and follow and monitor them. Every time Wang Yingqiang returned from petitioning, Ma Yongkui would deliberately cause trouble, loudly curse and threaten him, and make trouble near the courtyard of Wang Yingqiang’s home. The surveillance equipment at the scene of the incident was aimed directly at Wang Yingqiang’s front door and had monitored the family for a long time, precisely recording the entire course of the incident.

On September 27, 2022, victim Ma Yongkui repeatedly went to the gate of victim Wang Yingqiang’s home without cause, shouting abuse and causing a disturbance. The police officers from the Jinxu Road police station in the area who responded that day did not take any action against Ma Yongkui or criticize and educate him. They did not even confiscate the 30-centimeter-long knife Ma Yongkui had used to attack people before leaving. At around 8 a.m. on September 28, Ma Yongkui again entered the courtyard of Wang Yingqiang and Wang Xiaogang’s home with a 30-centimeter-long knife to cause trouble, and was injured by mentally ill patient Wang Xiaogang acting in legitimate self-defense. Subsequently, Ma Yongkui’s son, defendant Ma Jianjun, drove an off-road vehicle (license plate Shaanxi A3E79D) into Wang Yingqiang’s courtyard and rammed Wang Yingqiang. The vehicle first violently struck his father Ma Yongkui, who was already sitting on the ground. Victim Ma Yongkui was consequently thrown heavily against an iron pillar, while the off-road vehicle pushed against his lower body, causing violent twisting of his body, and then directly ran over him. After getting out and discovering that he had run over his own father, defendant Ma Jianjun immediately reversed over victim Ma Yongkui a second time, causing Ma Yongkui to go into shock at the scene (Ma Yongkui later died after resuscitation failed. The medical records state: 16 fractured ribs on both sides of the chest, a fractured sternum, multiple pelvic fractures, a fractured left ilium, and multiple contusions and hemorrhages of abdominal organs, among other injuries). The vehicle also rammed Wang Yingqiang, who was sitting on a stone stool in his own courtyard, breaking the stone table and stools. Wang Yingqiang was hit in the lower body, his head and upper body slammed into the hood, and he was then thrown backward. After defendant Ma Jianjun realized that he had rammed and run over his father and caused him to go into shock, he drove the vehicle backward and again entered Wang Yingqiang’s courtyard with the intention of attacking people, but was injured by Wang Xiaogang acting in legitimate self-defense.

After the incident, the Xixian New Area Public Security Sub-bureau immediately took away mentally ill patient Wang Xiaogang, who had acted in legitimate self-defense in his own courtyard, while using every means to shield and protect the real killer, Ma Jianjun, who had driven an off-road vehicle into Wang Yingqiang’s courtyard, run over and killed Ma Yongkui and injured Wang Yingqiang, and did not arrest him. To cover up his dereliction of duty on September 27, 2022, Zhang Shuli, director of the Jinxu Road police station, illegally used AI technology to cut and process surveillance video of Ma Yongkui going to Wang Yingqiang’s home with a 30-centimeter-long knife to attack people on September 27, 2022. If the Jinxu Road police station had lawfully confiscated his controlled weapon and taken compulsory measures against him when it responded on September 27, 2022, the tragedy of September 28, 2022, would never have occurred. After the incident, to shield the real killer Ma Jianjun, Zhang Shuli and others worked with Liang Jin, Li Ge and other police officers handling the case for the Xixian New Area to find more than a dozen friends and fellow villagers of Ma Yongkui in the community where the incident occurred to give false testimony and frame victims Wang Yingqiang and Wang Xiaogang, father and son.

Such a simple September 28 intentional-injury case was illegally divided by Wang Lin, deputy captain of the criminal investigation team of the Xixian New Area Public Security Sub-bureau of the Xi’an Public Security Bureau, and police officers Li Ge, Liang Jin and others into a Wang Xiaogang intentional-injury case and a Ma Jianjun intentional-injury case, bending the law for personal gain to shield the real killer Ma Jianjun. Only 77 days after the September 28 incident did Liang Jin and others take compulsory measures against Ma Jianjun. They said that before then police officers had been assigned to guard him while he received treatment, but his injury assessment classified the injuries as only minor, and he did not need to remain hospitalized for so long. Liang Jin and the others even defied common sense and illegally determined that Ma Jianjun’s reporting to the authorities voluntarily after leaving the hospital constituted surrender.

On September 29, 2022, Wang Xiaogang was placed under residential surveillance at a designated location by the Xixian New Area Sub-bureau of the Xi’an Public Security Bureau (the Xixian Sub-bureau) on suspicion of intentional injury. On October 31, 2022, the Xixian Sub-bureau changed the compulsory measure to criminal detention, and he was detained at the Weicheng District Detention Center. His admission physical examination form showed that Wang Xiaogang was in good health. During his detention, the Weicheng District Detention Center repeatedly made things difficult and prevented his lawyer, Shao Chenyang, from meeting him. On July 19, 2024, he was sent to hospital because of massive gastrointestinal bleeding and died on July 23. An autopsy report by the Judicial Appraisal Center of Xi’an Jiaotong University’s Department of Forensic Medicine confirmed that the cause of death was hemorrhagic shock caused by rupture of a gastrointestinal-wall leiomyosarcoma, but there were systematic violations of law and dereliction of duty in the supervisory and medical processes. After Wang Xiaogang’s abnormal death at the Weicheng District Detention Center, Gui Cunshe, director of the Weicheng District Public Security Bureau of Xianyang City, and others did not handle the matter lawfully at the first opportunity. Instead, they reported false materials everywhere to conceal the truth of Wang Xiaogang’s death. Police officer Wang Chao of the Weicheng District Public Security Bureau told victim Wang Xiaoqin, Wang Xiaogang’s younger sister, that the Ministry of Public Security had once sent the Shaanxi Provincial Public Security Department to the Weicheng District Detention Center to learn about the situation, but ended the matter after reviewing the so-called internal investigation report of the Weicheng District Public Security Bureau. Wang Chao said that if Wang Xiaogang’s family agreed to accept only 70,000 yuan as the price of Wang Xiaogang’s life without holding the detention center legally accountable, and said that the three detainees who had previously died at the Weicheng District Detention Center had each received only 70,000 yuan and that each case had been handled within a week.

After the incident, the father of victim Wang Xiaogang, who had been run over and left bedridden when the killer Ma Jianjun drove to his home to attack people, spent his days bathing in tears and could not accept the cruel reality of a parent burying a child. Victim Wang Xiaogang’s younger sister, Wang Xiaoqin, repeatedly mailed complaint materials to Wang Xiaohong, minister of public security, and Dai Binbin, director of the Shaanxi Provincial Public Security Department, but they disappeared without a trace. More than a year has passed since the incident, and no one from the Ministry of Public Security or the Shaanxi Provincial Public Security Department has ever proactively contacted the victim’s family to learn about or discuss the case. Instead, no matter where the victim’s family complained, Gui Cunshe and others used every means to cover up the wrongdoing. As a result, deceased Wang Xiaogang still cannot rest in peace, and his family has endured suppression and persecution.

The eight persons complained against above have seriously violated:

1. Political discipline: Being disloyal and dishonest toward the Party, failing to perform their statutory duties of governing the country and handling cases in accordance with the law, illegally shielding and conniving at the illegal conduct of all persons involved in the case, and undermining political rules.

2. Organizational discipline: Seriously violating organizational principles and showing favoritism in the selection and appointment of officials or in handling problems.

3. Integrity discipline: Abusing power to conceal the truth of the case and seek benefits for others.

4. Work discipline: Serious dereliction of duty, abuse of power, and shielding and conniving at all persons involved in the case, among other conduct.

5. Discipline concerning relations with the people: The illegal conduct of all persons involved seriously infringed upon victim Wang Xiaogang’s rights to life, health and personal liberty, as well as the relevant rights and interests of the victim’s family. The shielding by leaders including Wang Xiaohong and Dai Binbin also violated discipline concerning relations with the people.

II、Suspected criminal facts and chain of evidence

(I)Dereliction of duty: Systematic disregard for detainees’ rights to life and health

1. Delay in treatment

Surveillance footage from July 10, 2024, shows that Wang Xiaogang remained unconscious and motionless from the time he got up at 06:09 in the morning and did not eat breakfast. At 07:25, guard Wang Weidong entered Room 206, pointed at Wang Xiaogang lying motionless on the bed, briefly questioned detainee Wu Diao and left. Wang Xiaogang did not fully regain consciousness until 14:07, meaning he was left unattended while unconscious for about eight hours.

Surveillance footage from July 11 shows that Wang Xiaogang had developed confusion and was unable to stand. Station doctor Wang Haiyang merely suggested “increasing the nutritional meals” but did not initiate a medical assessment (the investigation file for the death of Wang Xiaogang, a detainee at the Weicheng District Detention Center). On the morning of July 11, Wang Xiaogang did not eat breakfast because he was suffering from illness. At 09:48, a guard entered (someone called him the instructor) and ordered Wang Xiaogang to meet people from the court. Wang Xiaogang said on the spot: “I haven’t been able to move for the past two days; I can’t even eat.” But the guard showed no concern for Wang Xiaogang’s condition and instead called several people to forcibly carry him out of the cell to meet people from the court. At 10:07, Wang Xiaogang was carried back to the cell, unconscious at the time. At 10:14, during a lawyer meeting, Wang Xiaogang was again forcibly carried out of the cell by several people. At 10:35, he was carried back to the cell and said: “It feels like all the bones in my body have fallen apart; I can’t move.” At 10:38, he lost consciousness again and did not wake until 15:17. At 15:53, guard Wang Weidong entered Room 206 and called Wang Xiaogang out for a talk. Wang Xiaogang said: “I haven’t eaten breakfast, and I have severe iron-deficiency anemia. I feel very dizzy……” (The remainder could not be heard clearly because of the noise.) At 15:55, several detainees wearing blue vests numbered 001 (Wu Diao), 040 and 578 forcibly pulled Wang Xiaogang from his bed and carried him out of the cell. At 16:04, Wang Xiaogang returned to the cell, limping and leaning against the wall, appearing to be in great discomfort. He appeared to have an injury to his foot and could not even put on his shoe.

On July 12, 13, 14 and 16, Wang Xiaogang all displayed obvious symptoms including severe abdominal discomfort and dry heaving, but no one paid attention or provided treatment.

At 09:57 on July 18, Wang Xiaogang was called out of the cell; his whereabouts were unknown. At 10:11, he was carried back in an unconscious state. The guard merely shouted, “He may have low blood sugar; give him some sugar water,” and then left. Wang Xiaogang did not regain consciousness until 11:46.

At 12:13 on July 19, Wang Xiaogang fainted for the first time that day. The detention center then delayed six hours before sending him for medical treatment, violating Article 26 of the Regulations on Detention Centers, which states that a person with a serious condition should be sent for medical treatment immediately (the investigation file for the death of Wang Xiaogang, a detainee at the Weicheng District Detention Center).

At 02:50 on July 20, detention-center staff, although confirmation should have been signed by the responsible person of the unit, telephoned the family and urged them to go to the hospital to sign. The person responsible for the detention center, Director Zhang Minghui, did not sign the surgical consent form until 11:40, nearly nine hours later, delaying the best opportunity for treatment and causing the hemorrhagic shock to worsen (the informed-consent form for interventional diagnosis and treatment of hemorrhagic disease at Yan’an University Xianyang Hospital and Wang Xiaogang’s inpatient medical records).

(II)Crime of abusing detainees: Long-term tolerance of violence and systematic management dereliction

1. The existence of a prison boss and bully

Detainee No. 181 in a blue vest (the “big boss”) controlled order in the cell and carried out physical punishment and withheld food (summary of surveillance viewed by Wang Xiaoqin).

Surveillance footage from July 11 to 19, 2024, shows that detainees wearing blue vests numbered 143, 040, 578, 220 and 320 bullied Wang Xiaogang violently to varying degrees. Those numbered 143, 040 and 578 were particularly egregious and severe.

On July 16, detainee No. 040 in a blue vest repeatedly cursed at and threatened Wang Xiaogang and hit him with a shoe. At 18:30, he struck Wang Xiaogang’s head. On July 17, detainee No. 578 hit the back of his head (summary of surveillance viewed by Wang Xiaoqin).

2. Supervisory personnel tacitly permitted the abuse

In September 2023, Wang Xiaogang reported that a guard had kicked him in the left chest. The detention center said, “The surveillance covers it.”

Beginning in May 2024, guards frequently contacted the family and said he was “having an episode” and “malnourished,” corroborating the long-term abuse.

III、Legal grounds and analysis of criminal liability

1. Crime of dereliction of duty(Article 397 of the Criminal Law):

The Detailed Rules for Law Enforcement by Detention Centers provide: (3) Handling of detainees who become ill and receive treatment inside the facility: 1. Medical personnel shall promptly examine detainees who are ill. For common illnesses that do not require hospital treatment, symptomatic treatment shall be provided and the detainee shall be monitored. (4) Handling of detainees who leave the facility for medical treatment: 1. For those with serious conditions or at risk of death, sudden illnesses, illnesses that persist without recovery and whose conditions have not been controlled, or unknown illnesses requiring diagnosis, where treatment outside the facility is necessary, the doctor shall promptly report to the director and, after approval, send the detainee to hospital for diagnosis and treatment.

Article 26 of the Regulations of the People’s Republic of China on Detention Centers provides that detention centers shall be equipped with necessary medical equipment and commonly used medicines. Detainees who fall ill shall be given timely treatment; those needing hospital treatment shall be treated by the local hospital; and those with serious conditions may, in accordance with law, be released on bail pending trial or receive medical parole.

Zhang Minghui and the others knew that Wang Xiaogang suffered from a malignant tumor and severe anemia, but failed to fulfill their medical safeguards obligations under the Detailed Rules for Law Enforcement by Detention Centers and the Regulations of the People’s Republic of China on Detention Centers. This directly caused a delay in treatment and resulted in his death, meeting the provisions of Article 1 of the Interpretation of the Supreme People’s Court and the Supreme People’s Procuratorate on Several Issues Concerning the Application of Law in Handling Criminal Cases of Dereliction of Duty: “Where state-agency personnel abuse their power or are derelict in their duties, and one of the following circumstances exists, it shall be determined as ‘causing major losses to public property or to the interests of the state and the people’ as provided in Article 397 of the Criminal Law, constituting the crime of dereliction of duty.”

2. Crime of abusing detainees(Article 248 of the Criminal Law):

Long-term tolerance of detainees beating Wang Xiaogang, forcing him to stand as punishment and restricting his food, causing multiple injuries throughout his body, meets the element of “serious circumstances.”

In conclusion, Zhang Minghui and the others are suspected of the crimes of dereliction of duty and abusing detainees. We earnestly request that the Central Inspection Team immediately file a case and investigate them, hold them criminally accountable and initiate state compensation proceedings (Articles 3 and 17 of the State Compensation Law). As this case involves cross-departmental dereliction of duty and abuse, it is recommended that the Central Inspection Team transfer it to the Central Commission for Discipline Inspection and the National Commission of Supervision to establish a special task force and designate an out-of-province jurisdiction outside Shaanxi to handle it, conducting a “double investigation of one case.” The authorities should communicate personally with the victim’s family about the true circumstances of the case, investigate it openly and covertly, handle it in accordance with the law, restore justice to the deceased Wang Xiaogang and compensate the victim’s family in accordance with the law.
