I,Name and Proposed Form of the Legislative Project

Project name: Regulations of Shaanxi Province on the Prevention and Correction of Wrongful Convictions and Retrospective Accountability for Law Enforcement and Judicial Conduct.

Proposed form: Local regulation. We recommend that the Legislative Affairs Commission of the Provincial People’s Congress Standing Committee hear proposals in person from at least five to ten representatives advocating for people affected by wrongful cases, conduct legislative research and draft the bill, and submit it to a meeting of the Provincial People’s Congress Standing Committee for deliberation when conditions are ripe.

II,Necessity of the Legislation

(1)Fair administration of justice is the last line of defense for upholding social fairness and justice.

At present, issues raised in public letters and visits—including public security, procuratorial and judicial authorities breaking the law while enforcing it, judicial unfairness, petitions left unresolved for long periods, and difficulties filing appeals and correcting errors—remain prominent concerns widely shared by society. Many cases involve distorted findings of fact, fabricated or improperly accepted evidence, procedural errors, and improper interference with the exercise of power. These seriously undermine public confidence in the justice system and the public’s sense of gains from comprehensively governing the country according to law.

(2)Existing correction and accountability mechanisms lack systematic institutional support at the local level.

The investigation of wrongful cases, initiation of retrials by higher-level courts, state compensation, restoration of reputation, retrospective accountability, jurisdiction outside the locality, and protection of complainants are currently addressed in scattered provisions of laws, judicial interpretations, and internal work rules. No local regulation has yet established a connected system with clear responsibilities and powers that is actionable, subject to oversight, and enforceable through accountability. In practice, this can lead to situations where authorities “explain but do not correct errors, reply but take no action, repeatedly fob people off with old replies,” and where “the agency being accused conducts its own review and issues its own response,” creating conflicts of interest.

(3)Specific problems that have provoked strong public concern urgently require a legislative response.

According to reports from 256 people who jointly signed the petition and the attached case materials, cases involving criminal matters, administrative litigation, medical injury, determinations of legitimate self-defense, and unnatural deaths of detainees in detention centers have involved coerced confessions, unlawful case filing, wrongful judgments, suppression of cases without investigation, public security, procuratorial and judicial authorities colluding to fabricate wrongful cases, and obstruction of appeals, complaints and reports. After problems were reported to the Central Inspection Group No. 15, the provincial joint inspection group, procuratorial authorities, public security authorities and courts, there were instances of no receipt being issued, irregular referrals, complaint and accusation materials being forwarded in violation of confidentiality rules to the entities accused, false replies issued by the reported entities themselves, complaint, report and appeal review procedures going through the motions, and no retrospective accountability for those responsible. These issues affect the vital interests of the public, public confidence in the justice system, and the authority of the central inspection and oversight systems.

(4)Enacting these regulations is necessary to implement the requirements of the Constitution, laws and the Supervision Law.

The Supervision Law of the Standing Committees of People’s Congresses at All Levels of the People’s Republic of China and the Measures of Shaanxi Province for Implementing the Supervision Law of the Standing Committees of People’s Congresses at All Levels of the People’s Republic of China make clear that standing committees of people’s congresses should conduct oversight focused on issues raised in public letters and visits and major issues of broad public concern. Elevating the prevention and correction of wrongful cases and retrospective accountability into local regulations would help advance the principles that “errors must be corrected, responsibility must be pursued, interference must be investigated, conflicts of interest must be avoided through out-of-area handling, and complainants must be protected,” and serve Shaanxi’s overall interests in reform, development and stability.

III,Feasibility of the Legislation

(1)Adequate basis in higher-level law. The Constitution’s provisions on citizens’ personal liberty, personal dignity and right to compensation; the Criminal Procedure Law’s provisions on retrials, appeals and exclusion of illegally obtained evidence; the Civil Procedure Law and Administrative Litigation Law provisions on trial supervision procedures; the State Compensation Law; the Law on Governmental Sanctions for Public Officials; the Supervision Law; and the provisions in the Regulations on Disciplinary Sanctions of the Communist Party of China governing sanctions for unlawful interference in judicial activities and intervention in the handling of specific cases together provide the legal basis for these regulations.

(2)Urgent need to address current problems. In recent years, chaos and serious problems have arisen across our province in resolving petitions involving litigation, checks and oversight of law enforcement and judicial work, lifetime responsibility for case quality, retrospective accountability for wrongful cases, and the “Three Provisions” on preventing interference in judicial work. Legislation is urgently needed to regulate these matters, effectively protect the lawful rights and interests of the public, and ensure that the principle of governing the country according to law is put into practice.

(3)The time is ripe for legislation. The Provincial People’s Congress Standing Committee is preparing its 2027 legislative work plan and has publicly solicited proposals for 2027 oversight topics. Legislation and oversight can be planned together and support each other: legislation can consolidate institutional outcomes, while special oversight can assess implementation, forming a closed loop of “legislation—oversight—rectification—assessment.”

IV,Main Issues the Legislation Is Intended to Address

(1)A regular mechanism to investigate and correct wrongful cases in accordance with law. Clarify that people’s courts, people’s procuratorates, public security organs and supervisory organs must systematically investigate cases that may contain errors in connection with petitions and complaints, retrial applications, and state compensation cases. For judgments, decisions and coercive measures that are indeed erroneous, procedures for retrial outside the locality, revocation, compensation, correction of errors, accountability and restoration of reputation should be promptly initiated in accordance with law, preventing correction procedures from becoming a mere formality.

(2)A mechanism for retrospective accountability and lifetime accountability for misconduct in law enforcement and judicial work. Clarify that, in cases of intentional perversion of the law, bending the law for personal connections, coerced confessions, fabricated evidence, unlawful case filing, unlawful seizure or impoundment, abuse of coercive measures, failure to conduct on-site supervision, suppression of cases without investigation, false replies to petitioners, or obstruction of appeals, the case handlers, reviewers and approvers shall be held accountable in accordance with Party discipline and the law. Issues such as leading officials’ unlawful intervention in specific cases, making calls on behalf of a party, or issuing written instructions shall be handled in coordination with discipline inspection and supervision, with dual investigations in each case.

(3)A mechanism for out-of-area jurisdiction over major, sensitive and power-related cases. Clarify that cases with a high risk of local interference, strong public petition activity, or possible local protectionism or internal cover-ups should be handled, in accordance with law, through designated jurisdiction, higher-level jurisdiction, investigation outside the locality, prosecution review outside the locality, trial outside the locality, or appeal review outside the locality. This would change the conflict-of-interest situation and establish actionable, supervisable and enforceable institutional rules.

(4)A standardized process for handling petitions involving litigation and reports to inspection groups. Clarify that collective joint letters mailed or delivered by members of the public to the Central Inspection Group or provincial joint inspection group shall be lawfully received and registered, referred for handling, and followed by written feedback to the victims. It shall be strictly prohibited to forward complaint and accusation materials to the entity being accused in violation of confidentiality rules. Causes shall be ascertained and accountability pursued for issues such as “no notice of acceptance received,” “the post office restricts the recipient’s name and remarks,” and “refusal to accept at the service window.”

(5)Protection mechanisms for people reporting crimes, appellants and whistleblowers. Clarify that members of the public who report problems to inspection groups, people’s congresses, procuratorial organs, or discipline inspection and supervisory organs must not be intercepted, threatened, have their information disclosed, or face retaliation. Establish systems for keeping whistleblowers’ information confidential, warning of risks, and pursuing accountability for rights violations.

(6)Coordination mechanisms linking oversight by people’s congresses with procuratorial oversight, supervisory oversight, and political-legal inspection. Clarify that issues found through people’s congress oversight shall be referred in a closed loop, rectified by a deadline, and publicly reported. For inadequate or false rectification, or retaliation against victims, complainants or appellants, mandatory oversight measures such as inquiries and focused investigations into specific issues shall be initiated in accordance with law.

V,To ensure these regulations are legally sound, workable, and effective,we recommend that the draft expressly establish the following three mandatory systems:

(1)Establish the rights of victims of wrongful cases to participate, make statements and exercise oversight. Expressly stipulate that for every wrongful case entering a review, retrial, compensation or accountability procedure, the victim or their close relatives and friends shall be notified to participate in relevant legislative research forums, special inquiries, representative inspections and third-party reviews. When institutional rules concerning the same types of cases are formulated or amended, representatives of victims of wrongful cases shall be invited to legislative forums, legislative hearings and legislative deliberations as observers, and their views shall be fully heard. Statements and proposals by victim representatives during legislative deliberations and special inquiries shall be accurately recorded and included in legislative files, and the legislative body shall provide written feedback on whether they were adopted.

(2)Establish the principle that retrospective accountability has no forbidden zones, and retirement does not exempt anyone from lifetime accountability. Expressly stipulate that law enforcement and judicial personnel who intentionally or through gross negligence cause wrongful cases in the course of handling cases shall have their responsibility investigated in accordance with Party discipline and the law, regardless of whether they have been transferred, rotated, dismissed, expelled, retired or left their jobs. Responsibility must not be waived on grounds such as a change of post, adjustment of position, retirement or departure, or expiration of the general time limit for accountability. The conclusions of retrospective accountability shall be communicated in writing to the victim, and the case handlers, reviewers and approvers shall be held correspondingly accountable in accordance with law.

(3)Establish in-person communication and written response requirements for implementing corrections. Expressly stipulate that after a wrongful case has been corrected in accordance with law, relevant working bodies of the Provincial People’s Congress Standing Committee, together with the Shaanxi Provincial Supervisory Commission, Shaanxi Higher People’s Court, Shaanxi People’s Procuratorate and Shaanxi Provincial Public Security Department, shall jointly brief the victim in person on the correction conclusion, progress in retrospective accountability, and follow-up arrangements for compensation and restoration of reputation, and issue a written response within the statutory time limit from the date the correction decision is made. The written response shall specify the findings of fact, legal basis, disposition and avenues for correction and compensation; shall be jointly signed and sealed by the participating agencies; and shall provide one response and one file for each case, firmly preventing “explaining but not correcting errors, replying but taking no action.”

VI,Recommended Supporting Work

(1) We recommend that, while advancing legislative research on these regulations, the Provincial People’s Congress Standing Committee include “standardized handling of litigation-related petitions across the province, lawful correction of wrongful cases, protection of information about people reporting to inspection groups, out-of-area jurisdiction of major cases, and retrospective accountability for law enforcement and judicial conduct” in its 2027 oversight agenda, and conduct special oversight through special work reports, thematic research, law enforcement inspections, special inquiries and other means.

(2) We recommend allowing representatives advocating for people affected by wrongful cases to participate in hearing special work reports from the Provincial Supervisory Commission, Provincial Higher People’s Court, Provincial People’s Procuratorate and Provincial Public Security Department on the above matters; conducting special inquiries into “inspection reports being referred back to the entity being reported, disclosure of complainants’ information, and unnatural deaths of people in custody,” allowing multiple representatives advocating for people affected by wrongful cases to participate and speak at the meeting; and conducting representative inspections and third-party reviews outside the locality of several typical cases raised by the 256 members of the public.

(3) We recommend urging the establishment of a closed-loop system for the governance and oversight of wrongful cases, with the joint participation of the Party Committee Political and Legal Affairs Commission, discipline inspection and supervisory commissions, and people’s congress oversight; conducting dual investigations in each case, applying lifetime accountability and awarding state compensation in accordance with law; requiring the relevant agencies to report in writing to the Provincial People’s Congress Standing Committee on progress in rectification; and making typical issues appropriately public.

VII,Special Proposal on Ensuring the Participation Rights of Representatives of Victims of Wrongful Cases in Shaanxi Provincial People’s Congress Sessions and Oversight Work of the People’s Congress Standing Committee, and Promoting Accountability in Accordance with Law for Those Who Deliberately Fabricate Wrongful Cases

1. Establish a system for representatives of victims of wrongful cases to attend sessions of the Shaanxi Provincial People’s Congress. Each year during sessions of the Shaanxi Provincial People’s Congress, the Provincial People’s Congress Standing Committee should invite a certain proportion of representatives of victims of wrongful cases, appellants and whistleblowers whose identities have been verified to attend relevant proceedings as observers and participate in special deliberations, special inquiries and hearings on the governance of wrongful cases. Victim representatives shall have the right to speak at relevant meetings, submit written materials and present their concerns. Their views shall be accurately recorded and included as references for people’s congress oversight and legislation, and the outcome shall be communicated to them in writing.

2. Initiate mandatory oversight procedures in accordance with law for leaders and officials in charge of case handling at public security, procuratorial, judicial and supervisory bodies who deliberately fabricated wrongful cases and provoked intense public outrage. For cases in which a retrial judgment, procuratorial oversight, supervisory investigation or a specific-issue investigation by the people’s congress has confirmed deliberate perversion of the law, bending the law for personal connections, coerced confessions, fabricated evidence, unlawful case filing, suppression of cases without investigation, or intervention, resulting in serious harm to citizens’ personal liberty, property or reputation, the Provincial People’s Congress Standing Committee should urge the Provincial Supervisory Commission, Provincial Higher People’s Court, Provincial People’s Procuratorate and Provincial Public Security Department to issue decisions on sanctions, accountability, compensation and restoration of reputation in accordance with law. For persons whose election or removal falls under the authority of the Provincial People’s Congress, the presidium, the Provincial People’s Congress Standing Committee, or at least one-tenth of provincial people’s congress representatives together with a certain proportion of representatives advocating for victims’ rights may jointly submit a motion for removal in accordance with law, for deliberation and voting under statutory procedures.

3. Retrospective accountability shall not be affected by retirement, transfer or removal from office. The responsibility of all persons who deliberately fabricated the wrongful cases described above shall be investigated in accordance with Party discipline and the law, regardless of whether they have been transferred from their original agency, removed from office, resigned or retired. They may not be exempted on grounds of a change of post, retirement or departure, or expiration of the general time limit for accountability. Retirement benefits and honors already received shall be reconsidered in accordance with law in light of the conclusions of the investigation.

4. The Provincial People’s Congress and Provincial Supervisory Commission shall jointly respond to victims in person regarding the results of corrections. For wrongful cases confirmed through review, after correction the relevant working bodies of the Provincial People’s Congress Standing Committee, together with the Provincial Supervisory Commission, Provincial Higher People’s Court, Provincial People’s Procuratorate and Provincial Public Security Department, shall jointly brief the victim in person on the correction, and issue a written response within the statutory time limit specifying the findings of fact, legal basis, disposition and avenues for remedy, with one response and one file for each case, to ensure that the correction process is open and transparent and that accountability is assigned to individuals.

VIII,Expected Outcomes

After these regulations are enacted, a full-chain system will be established at the local legislative level covering “investigation—correction—compensation—accountability—protection—oversight,” ensuring that wrongful cases have an entry point, corrections have procedures, accountability has no blind spots, complainants are protected, and oversight has teeth. This will effectively uphold judicial fairness and the authority of the rule of law and enhance the public’s sense of gains and satisfaction with law-based governance in Shaanxi.

IX,Requests

We respectfully request that the Legislative Affairs Commission of the Provincial People’s Congress Standing Committee and the Research Office of the Shaanxi Provincial People’s Congress Standing Committee include this project in the 2027 legislative plan and recommend it as an item for deliberation or a preparatory item. We also respectfully request that related special oversight topics be included in the 2027 oversight work plan, and that representatives advocating for people affected by wrongful cases be organized to participate in person in voting and speaking on this legislation, special inquiries and third-party reviews, to promote genuine correction, genuine accountability, genuine out-of-area handling and genuine protection.

Legislative correction of wrongful convictions is not a private matter for individual parties; it is a major matter related to the authority of the rule of law, public confidence in government and the province’s development environment. We respectfully request that this proposal be considered and adopted.
